Welcome to The Plant Stylist! These Terms of Service ("ToS") govern your use of our website, https://theplantstylist.com/, and any services offered by The Plant Stylist (referred to as "we," "us," or "our"). By accessing or using our website and services, you ("you" or "user") agree to be bound by these ToS. If you disagree with any part of the ToS, then you may not access the website.

4. Ordering and Payment

  • Order Acceptance: Placing an order does not guarantee acceptance. We reserve the right to cancel orders due to out-of-stock items, pricing errors, or other reasons.

  • Shipping Options: We offer standard shipping with an estimated delivery time of 5 business days. Delivery costs will vary based on order weight.
  • Delivery Area: We currently deliver within the United States.
  • Risk of Loss: The risk of loss for shipped plants passes to you upon delivery to the carrier.

6. Returns and Refunds

  • Return Policy: Due to the perishable nature of plants, we have a limited return policy.  Returns are accepted within 30 days of delivery for damaged or significantly misrepresented plants only. Customers are required to send photos of the plant.
  • Refund Process: Refunds will be issued to your original payment method within 30 days of receiving the returned item.

7. Intellectual Property

  • Ownership: All content on our website, including images, text, designs, and logos, is the intellectual property of The Plant Stylist and is protected by copyright and other intellectual property laws.
  • Restrictions: You may not use our content without our express written permission.

8. Disclaimers

  • Plant Health: We make no guarantees about the health or survival of your plants after delivery. Plant care is your responsibility.
  • Website Accuracy: We strive for accuracy, but we do not warrant that the information on our website is complete, accurate, or up-to-date.
  • Liability: To the fullest extent permitted by law, The Plant Stylist disclaims all liability for any damages arising from the use of our website or products.

9. Termination

10. Governing Law and Dispute Resolution

  • Governing Law: This agreement shall be governed by and construed in accordance with the laws of Illinois.  
  • Dispute Resolution: Any dispute arising out of or relating to this agreement shall be settled through mediation in Chicago.
